1. Acceptance of Terms
By placing an order with Cluster Technologies, you confirm that you are purchasing products and services for internal use only and not for resale. If you want to resell, please reach out to our sales team directly for specific reseller terms and conditions.
2. Purchase Orders
A purchase order will only serve as an accounting request. Any sales order containing additional or specific terms and conditions will be refused and be null and void immediately. Cluster Technologies can accept or reject all other new or separate terms and conditions, It does not constitute a concession or approval of those terms and conditions at any condition.
3. Product Availability and Pricing
All products and services listed on our website are subject to availability only. Prices and features are subject to change without notice. Cluster Technologies reserves the right to modify or discontinue products and services at any time without prior notice.
4. Payment Terms
Unless otherwise agreed upon, payment is due within 30 days from the date of our invoice. Cluster Technologies reserves the right to require full or partial payment in advance if your financial position is considered unsatisfactory. A service fee may be applied to overdue amounts as per the terms & conditions.
5. Taxes
All applicable taxes, not limited to sales, add-ons, or other taxes, are the responsibility of the customer and will be invoiced separately unless a valid exemption certificate is provided.
6. Shipment and Delivery
Products will be shipped from Cluster Technologies' facility. Title and risk of loss pass to the customer upon delivery to the carrier. Delivery dates are estimated and not guaranteed. Cluster Technologies is not liable for any delays in delivery.
7. Order Cancellation
Orders may be canceled prior to shipment or commencement of services. Cancellations after this point may incur charges for costs incurred by Cluster Technologies up to the point of cancellation.
8. Warranty and Returns
Products are covered by the manufacturer's warranty. Returns are subject to Cluster Technologies' return policy and may require prior authorization
9. Limitation of Liability
Cluster Technologies' liability is limited to the purchase price of the product or service in question. We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Cluster Technologies operates.
11. Changes to Terms
